These terms set out the conditions and procedures for using the website (vacatiohotel.com) of VACATIO Samseong ("the Hotel"), operated by Vacatio Inc. ("the Company"), and for booking and staying at the Hotel, together with the rights, obligations and responsibilities of the Company and its users. The Company complies with the Act on Consumer Protection in Electronic Commerce, the Act on the Regulation of Terms and Conditions and other applicable laws of the Republic of Korea. These terms apply the Company's company-wide terms of service (vacatio.us/terms) to the Hotel.
Article 1 (Purpose)
The purpose of these terms is to govern the rights, obligations and responsibilities between the Company and users, and the conditions and procedures, in connection with the Hotel website and bookings and stays at the Hotel.
Matters not covered by these terms are governed by applicable law, the conditions disclosed at the time of booking, and the Hotel's stay guide.
Article 2 (Definitions)
(1) "Website" means vacatiohotel.com, operated by the Company to introduce and provide information about the Hotel.
(2) "Accommodation Service" means the Hotel's rooms and the services that accompany them, such as the lobby salad café, smart rooms and robot room service.
(3) "Booking Page" means the accommodation booking screen operated by the Company (booking.vacatio.cloud).
(4) "User" means anyone who uses the Website or the Accommodation Service under these terms (website visitors, booking customers and guests).
Article 3 (Effect and amendment of these terms)
(1) These terms take effect when they are posted on the Website.
(2) The Company may amend these terms within the bounds of applicable law. When it does, it will post the effective date and reasons in the Website's notices at least 7 days before that date, or at least 30 days before for changes that are unfavourable to users or otherwise material.
(3) Bookings that are already confirmed remain subject to the terms and conditions in force when they were made.
Article 4 (Formation of a booking)
(1) A booking is formed when the user submits booking details and payment information on the Booking Page and the Company confirms the booking and notifies the user.
(2) The Company may decline a booking, or cancel it afterwards, where the applicant has used another person's identity, has provided false information, where no rooms are available, or where the purpose is plainly to breach applicable law or these terms.
(3) Bookings made through an external channel are also subject to that channel's terms and booking conditions.
(4) A minor may need the consent of a legal representative to stay, and a legal representative may cancel the booking in accordance with applicable law.
Article 5 (Rates, payment and refunds)
(1) Room rates, and whether VAT is included, are as shown on the Booking Page. The Website does not publish rates; the Booking Page prevails.
(2) Payments are processed through the payment services of NICE Payments Co., Ltd., and the information required for payment is provided to the payment gateway.
(3) Cancellations, changes and refunds follow the cancellation and refund policy disclosed at the time of booking. That policy applies only insofar as it is consistent with the Act on Consumer Protection in Electronic Commerce and the Korea Fair Trade Commission's Criteria for Resolution of Consumer Disputes; where it conflicts with the law, the law prevails.
(4) Where the Accommodation Service is not provided, or is provided differently from the booking, due to the Company's fault, the user may request a refund or a price reduction for the affected portion, and the Company will comply without delay. Refunds are made to the original payment method as a rule.
Article 6 (Check-in, check-out and the stay)
(1) Check-in is from 16:00 and check-out is by 11:00, unless otherwise stated at the time of booking.
(2) Check-in takes place at the lobby kiosk or with a mobile key, and the Hotel may ask to confirm the booking holder's details to verify guests.
(3) Guests must follow the in-room information and the stay guide, and must compensate for any damage to or loss of the room or its fittings caused intentionally or negligently.
(4) The Company may restrict a stay or ask a guest to leave in the event of conduct that endangers the safety or rest of other guests, or that is prohibited by law.
Article 7 (Obligations of the Company)
(1) The Company complies with applicable law and these terms, and endeavours to provide the Accommodation Service and the Website safely and reliably.
(2) The Company protects users' personal data in accordance with the Personal Information Protection Act and the Privacy Policy.
(3) Where the Company recognises an opinion or complaint raised by a user as legitimate, it will address it and inform the user of the progress and outcome.
Article 8 (Obligations of the user)
(1) Users must comply with applicable law, these terms and Company notices, and must provide accurate information when booking.
(2) Users must not use another person's identity or payment method, deliberately interfere with the Website, harvest Website data by automated means, or infringe the rights of the Company or a third party.
Article 9 (Changes to and suspension of the Website)
(1) The Company may change the Website's content, or suspend it temporarily for maintenance, for operational or technical reasons.
(2) Descriptions of rooms, facilities and programs on the Website are for guidance; photos may differ from the actual rooms, and the Booking Page and the booking confirmation prevail as to specific conditions.
Article 10 (Intellectual property)
Intellectual property rights in the Website's text, photographs, design, trade marks and other works belong to the Company or to the rightful owner, and users may not copy, distribute or commercially exploit them without the Company's prior consent.
Article 11 (Limitation of liability)
(1) The Company is not responsible for failure to provide the service caused by force majeure, such as natural disaster, power failure or network outage.
(2) The Company is not responsible for loss caused by the user's own fault, such as entering incorrect information, failing to safeguard a payment method, or not following the stay guide.
(3) The Company is not responsible for loss arising from failures in third-party systems such as external booking channels or payment gateways, insofar as they are outside its control. It will, however, inform users as soon as it becomes aware of such a failure and cooperate in restoring service.
(4) The exclusions in this Article do not apply to loss caused by the Company's intent or gross negligence, or to any other loss for which exclusion is not permitted by law.
Article 12 (Dispute resolution, governing law and jurisdiction)
(1) The Company endeavours to address legitimate opinions and complaints raised by users; enquiries may be sent to operation@vacatio.us.
(2) In the event of a dispute, the Company and the user will seek to resolve it by agreement. Failing agreement, a user may apply for mediation to the Korea Consumer Agency's consumer counselling centre (1372) or to the Electronic Commerce Mediation Committee.
(3) These terms and the use of the service are governed by the laws of the Republic of Korea, and any lawsuit is to be brought before the court having jurisdiction under the Civil Procedure Act.
